CloudTV Voice Terms of Use

These terms and conditions (“CloudTV Voice Terms of Use”) apply to your use of products and services offered by CloudWalker Streaming Technologies Pvt. Ltd.. (“we” or “us” or the “CloudTV”), including any content, functionality and services offered on or via www.cloudwalker.tv, www.cloudtvos.com, CloudTV Remote App, CloudTV OS Devices and other products, services or offerings owned and operated by the CloudTV (collectively referred to as the “Platform” or “Applications”). For the purpose of these CloudTV Voice Terms of Use:

"CloudTV Voice" means CloudTV’s voice services, which includes Third Party Services, digital content, Software, the CloudTV Remote App, and support and other related services.

"CloudTV Voice App" means the app or website provided by CloudTV that provides access to CloudTV Voice, CloudTV Voice’s settings, CloudTV Voice-related content, and other information.

"CloudTV Voice Enabled Product" means any product or application that enables access to CloudTV Voice.

“CloudTV Voice Interactions” means all information related to your use of CloudTV Voice and CloudTV Voice Enabled Products, including your voice and other inputs, responses provided to you through CloudTV Voice, information we receive in connection with Third Party Services and Auxiliary Products you use, and information and content you provide or receive through the CloudTV Voice App.

“Auxiliary Product” means any product you can interact with or operate using an CloudTV Voice Enabled Product, including Televisions, Smart Screens, Monitors, Speakers, Set-top Boxes, SmartPhones, etc.

“Auxiliary Product” means any product you can interact with or operate using an CloudTV Voice Enabled Product, including Televisions, Smart Screens, Monitors, Speakers, Set-top Boxes, SmartPhones, etc.

"Third Party Service" means any service or application provided by a third party that we make available to you for use on or through CloudTV Voice.

CloudTV Voice

1. CloudTV Voice. An CloudTV Voice Enabled Product and internet connection are required to access and use CloudTV Voice. Some CloudTV Voice services may not be available in all areas or on all CloudTV Voice Enabled Products and may require separate fees or subscriptions.
2. Use of the Software. You may use the Software only on or through an CloudTV Voice Enabled Product or Auxiliary Product, and you may only make personal and non-commercial use of CloudTV Voice.
3. CloudTV Voice’s Interactions. You control CloudTV Voice with your voice. CloudTV Voice records and sends audio to the cloud when you interact with CloudTV Voice. CloudTV processes and retains your CloudTV Voice Interactions, such as your voice inputs, search history, content viewing behaviour, etc in the cloud to provide, personalize, and improve our services.

Third Party Services; Third Party Products.

1. Third Party Services. If you use a Third Party Service, we may exchange related information with that service, such as your ZIP code when you ask for the weather, your custom music stations, information about your Auxiliary Products, or the content of your requests. Your use of any Third Party Service is subject to this Agreement and any third party terms applicable to such Third Party Service. When using a Third Party Service, you are responsible for any information you provide to the third party. CloudTV has no responsibility or liability for Third Party Services. Publishers of Third Party Services may change or discontinue the functionality or features of their Third Party Service.
2. Third Party Products. CloudTV Voice Enabled Products and Auxiliary Products include third party products that CloudTV does not manufacture or develop. CloudTV may automatically update the firmware for certain Auxiliary Products on behalf of the applicable manufacturer or brand. CloudTV has no responsibility or liability for such third party products or manufacturer-provided firmware.

General

1. Information. The Software will provide CloudTV with information about your use of CloudTV Voice, your CloudTV Voice Interactions, and your CloudTV Voice Enabled Products and Auxiliary Products (such as device type, name, features, status, network connectivity, software performance, and location). This information may be stored on servers outside the country in which you live. We will handle any information we receive in accordance with the CloudTV Privacy Policy.
2. Functionality; Content. We do not guarantee that CloudTV Voice or its functionality or content is accurate, reliable, always available, or complete. You may encounter content through CloudTV Voice that you find offensive, indecent, or objectionable. CloudTV has no responsibility or liability for such content.
3. Changes to CloudTV Voice; Amendments. We may change, suspend, or discontinue CloudTV Voice , or any part of it, including any Third Party Services or Premium Features, at any time without notice. We may amend any of this Agreement's terms at our sole discretion by posting the revised terms on the cloudtvos.com website. Your continued use of CloudTV Voice after the effective date of the revised Agreement constitutes your acceptance of the terms.
4. Geographic Restrictions. CloudTV Voice is operated in the India. We may restrict access to CloudTV Voice or certain CloudTV Voice features from other locations.
5. Termination. We may terminate your access to CloudTV Voice at our discretion without notice (except as may be required by applicable law). Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, CloudTV may immediately revoke your access to CloudTV Voice without refund of any fees. CloudTV’s failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.
6. Disputes. Any dispute or claim arising from or relating to this Agreement or CloudTV Voice is subject to the dispute resolution, governing law, disclaimer of warranties, limitation of liability, and all other terms in the CloudTV’s Terms & Conditions.
7. Disclaimer of Warranties and Limitation of Liability. Without limiting the Disclaimer of Warranties and Limitation of Liability terms in the CloudTV’s Terms & Conditions, and unless otherwise required by applicable law, in no event will our or our licensors' or our service providers' aggregate liability with respect to any claim arising from or relating to this Agreement or your use of CloudTV Voice exceed INR 100 (Indian Rupees One Hundred Only).
8. Severability. If any term or condition of this Agreement is deemed invalid, void, or for any reason unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining term or condition.
